Firstly let us start off by saying CARI Child Abduction Recovery International is always the first to condemn India and its family court system BUT whether you like it or not they got it right in this case….
We have posted in the past on this case expressing the TRUE story that the mother was the original kidnapper despite all her lies to the Dutch media and public. We have been sent trolls by the mother attack us for sharing the TRUE story. Insiya is now in her habitual residence with her custodial parent…her father. She was born and raised in India before her mother tricked the father.
There’s definitely no winners in this massive media circus created by the kidnapper (mother) crying wolf. Whether right or wrong (we state…it was done very wrong and illegally) how the father recovered his kidnapped daughter today the Indian court has made the final decision. She’s staying permanently in the place she’s grown up in before being abducted by retention in the Netherlands.
Abduction by retention as in this case is the number one way kids are kidnapped these days and why parents like this father revert to desperate measures. The mother in this case lied to the father stating she was travelling to the Netherlands to get the child immunised before returning. That was a complete lie as with most kidnappers this mother had no intention of returning Insiya and with the assistance of her family kept Insiya illegally in the Netherlands. These are facts that can’t be disputed even by the mothers man hating trolls she sends to anyone who speaks out.
We have seen it in Poland, America, Australia and now the Netherlands mothers who kidnap their children then immediately run to the media to try and play the victim. Just doesn’t work now and pisses us off to see others promoting kidnappers!! The Dutch media have been very one sided with their reports since day one like in the recent Australian – Indonesian case with the Australian media, which is also common refusing to highlight the mothers actions. This is why we have stated many times for people not to jump on the media bandwagon before facts are determined. It’s usually bored trolls and ambulance chasers who have nothing better to do or have any idea on International Parental Child Abduction or its laws.
People supporting this kidnapper are wrong…people supporting the father are wrong….people supporting Insiya are correct!
The kidnapper refuses to make any comment…. funny that once the truth comes out.
We hope one day both parents will be able to be in little Insiya’s life as she is the real and only victim in this sad story.

Insiya, the now 4-year-old girl who was abducted from Amsterdam in September 2016, will stay in India with her father, a court in India ruled on appeal. The Indian judiciary considers her mother Nadia Rashid as the child’s abductor, not her father Shehzad Hemani, Hemani’s Indian lawyers told his Dutch lawyer Gerard Spong, Het Parool reports.
“And I have no reason to doubt my colleague, Mrs Nevill Majra”, Spong said to Het Parool. “I met her in Mumbai, an elegant and knowledgeable lawyer.” The Supreme Court in India has yet to publish the verdict.
Hemani and Rashid have been separated, and fighting over custody of Insiya, for years. Before their separation, they mainly lived in India. In 2014 Rashid came to the Netherlands with her daughter, to start the divorce procedures here. In September 2016, Inisya was violently abducted from her grandmother’s apartment in Amsterdam. According to the Dutch authorities, Hemani was behind the abduction, helped by seven accomplices. The girl was torn from her grandmother’s arms, and turned up in India weeks later, with her father.
The criminal case surrounding the abduction is being conducted in the Netherlands. But the lawsuit about who will get custody of Insiya had to be fought out in India. Rashid therefore started a custody case in India. A lower judge previously ruled that Insiya must be returned to her mother in the Netherlands in March this year, but Hemani managed to prevent this happening by appealing against the ruling. The Supreme Court in India now ruled that Insiya will live with him permanently, according to his lawyers.
The Indian judiciary also decided that mother Rashid can have video contact with Insiya several times a month. She is not available for comment, her lawyer, Peter Plasman, said to Het Parool.
A criminal case against Hemani and his seven accomplices is still ongoing in the Netherlands. Hemani is suspected of abducting the child. Whether a conviction against Hemani in the Netherlands will have any influence on the custody of Insiya, is not clear. Gerard Spong doesn’t think it will, because India sees Rashid as the “first abductor”, he said to the newspaper.
